Spouses and Immediate Relatives

Who is eligible?

A separate petition must be filed for each person immigrating. Note: A step-parent or child will qualify for immigration only if the marriage creating the step parent/child relationship occurred before the child's eighteenth birthday.

How do I apply?

The first step in applying for an immigrant visa is for the U.S. citizen (petitioner) to file an immigrant visa petition, form I-130, with the U.S. Citizenship and Immigration Services (USCIS) in the U.S. The petitioner must submit his/her I-130 at the Service Center with jurisdiction over the petitioner’s place of residence. USCIS maintains an office locator on its website: www.uscis.gov

When the petition has been approved, it will be forwarded to the National Visa Center (NVC). The National Visa Center will send the applicant a detailed list of supporting documents needed to apply for the immigrant visa. The National Visa Center will also send the visa applicant the form DS-3032, Choice of Address and Agent Form and the petitioner an Affidavit of Support with the processing fee bill.

Upon completion, the National Visa Center will forward the petition to the U.S. Embassy in Stockholm. Please note that the National Visa Center will also be responsible for scheduling the applicant for an interview at the Embassy.

Current Procedures for U.S. Citizens Resident in Sweden

U.S. citizens resident in Sweden who wish to sponsor an immediate relative (spouse or minor child), can file the I-130 petition at the U.S. Embassy in Stockholm, provided the U.S. Citizen petitioners can show that they have been legally residing in the consular district continuously for at least six months before filing the petition.

Please note:

Residence Requirement for U.S. citizens resident in Sweden:

  • Submit a copy of the Swedish residence stamp from the passport
  • Submit an extract from the population register (Personbevis) at the Swedish tax administration, Skatteverket phone number: 0771-567 567
